1. Agreement to Terms
By accessing or using the Headstart Tuition platform at headstarttuition.com.au - including signing in via Google OAuth - you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.
2. Platform Description
Headstart Tuition is a tutoring marketplace that connects parents and students with qualified tutors for in-home and online tutoring sessions. We provide the platform, booking tools, messaging, payment processing, and progress tracking - but tutors are independent contractors, not employees of Headstart Tuition.
3. Account Registration & Google OAuth
You may register and sign in using Google OAuth 2.0. By doing so, you authorise us to receive your name and email address from Google for the purpose of creating and managing your account. You are responsible for maintaining the security of your account and for all activity that occurs under it.
You must be at least 18 years old to create an account. Parents creating accounts on behalf of their children accept these terms on their behalf.
4. Bookings & Scheduling
Bookings are subject to tutor availability. A booking is confirmed only once payment has been received. Headstart Tuition reserves the right to reassign or reschedule sessions at our discretion to maintain service quality.
5. Cancellation Policy
- 48+ hours notice: Full refund or credit to account
- 24-48 hours notice: 50% refund or credit
- Less than 24 hours notice: No refund
- Emergency situations considered on a case-by-case basis
6. Payment Terms
Payment is required prior to sessions commencing. All payments are processed securely through Stripe. By making a payment, you also agree to Stripe's Terms of Service. All prices are in Australian Dollars (AUD) and include GST where applicable.
Package deals (5-lesson bundles and term packages) are non-refundable once lessons have commenced, except in extraordinary circumstances at our sole discretion.
7. Tutor Conduct
All tutors are independent contractors who agree to maintain professional standards, hold a valid Working With Children Check (WWCC), arrive on time, and provide quality educational support. Tutors must adhere to our code of conduct and safety policies at all times.
8. Parent & Student Responsibilities
- Parents must ensure a safe and appropriate learning environment for in-person sessions.
- A parent or guardian must be present in the home during in-person sessions involving students under 18.
- Users must not misuse or attempt to circumvent the platform (e.g. arranging lessons outside the platform to avoid fees).
9. Intellectual Property
All content on this platform, including branding, software, and materials, is the property of Headstart Tuition and may not be reproduced or used without written permission.
10. Limitation of Liability
Headstart Tuition does not guarantee specific academic outcomes. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
11. Privacy
Your use of the platform is also governed by our Privacy Policy, which is incorporated into these terms by reference.
12. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes via email. Continued use of the platform after changes constitutes acceptance of the updated terms.
